Terms and Conditions — The Latch Revolution
Last updated: June 2025
These Terms and Conditions apply to the purchase and use of Decoding the Suck: Gentle Support for Babies with Sucking Difficulties (the “Course”).
By purchasing the Course, you (“Participant” or “you”) agree to these Terms and Conditions.
The Course is provided by The Latch Revolution, a business partnership between Katie James and Johanna Sargeant (“The Latch Revolution”, “we”, “us” or “our”).
- About the Course
Decoding the Suck: Gentle Support for Babies with Sucking Difficulties is an online professional education course designed primarily for lactation professionals, midwives, doulas, birth workers, breastfeeding counsellors and other professionals supporting babies and families.
The Course includes educational videos and may include downloadable resources, clinical examples, assessment or observation tools, supporting materials and other educational content.
By purchasing the Course, you confirm that you have reviewed the Course description and understand the general nature and intended audience of the Course.
The Course is intended for professional education. It does not provide a professional qualification, licence to practise, or authorisation to work outside your existing professional scope.
- Payment and Refunds
Payment
The Course fee is the price displayed at the time of purchase.
Payment may be made in full or, where offered, through a payment plan using the payment methods available at checkout.
If you choose a payment plan, you agree to make the scheduled payments shown at checkout. A payment plan is a method of paying the total Course fee and is not a subscription that can ordinarily be cancelled part-way through.
If a scheduled payment fails, Course access may be temporarily suspended while payment is outstanding.
Currency
Prices may be displayed in different currencies. Your payment will be processed in the currency shown and selected at checkout. Your bank or payment provider may apply its own currency conversion or transaction charges.
7-Day Money-Back Guarantee
We offer a 7-day money-back guarantee from the date of purchase.
To request a refund, contact [email protected] within seven days of your purchase.
Where a valid refund is issued, your access to the Course and associated Course materials will end.
After the 7-day refund period has passed, Course fees are normally non-refundable, except where otherwise required by applicable law.
If you purchased using a payment plan and the refund period has passed, the remaining scheduled payments continue to be payable.
Nothing in these Terms is intended to limit any consumer rights that cannot lawfully be excluded.
- Course Access and Delivery
The Course is delivered online using Kajabi or another platform selected by The Latch Revolution.
You are responsible for having a suitable internet connection and device to access the Course.
Course Access
Where the Course is sold with “lifetime access”, this means access for as long as The Latch Revolution continues to host and make the Course available in its current or an equivalent format.
It does not mean that a particular platform, technology, lesson, resource or version of the Course will remain available indefinitely.
We may update, improve, replace or retire individual Course materials as professional knowledge, evidence, technology and the Course itself develop.
If we decide to discontinue the Course entirely, we will make reasonable efforts to provide participants with appropriate notice where practicable.
We are not responsible for temporary interruptions caused by internet providers, third-party platforms, maintenance or circumstances reasonably outside our control. We will, however, make reasonable efforts to restore access where an issue is within our control.
- Intellectual Property and Use of Course Materials
The Course and its original materials are protected by copyright and other applicable intellectual property laws.
Unless otherwise stated, Course videos, presentations, written materials, frameworks, assessment tools, downloadable resources, graphics and other original Course resources belong to The Latch Revolution and/or their respective creators.
Your purchase gives you a personal, non-exclusive, non-transferable right to access and use the Course for your own professional learning and practice.
What you may do
You are encouraged to apply the knowledge, clinical reasoning, principles and skills you learn through the Course within your own professional role and scope of practice.
Where a resource is specifically identified as suitable for use with clients or families, you may use that resource in accordance with any instructions or licence provided with it.
What you may not do
Unless we have given written permission, you may not:
- share your Course login with another person;
- reproduce or distribute substantial parts of the Course or its materials;
- upload Course materials to shared drives, membership sites, online groups or other platforms;
- sell, licence or commercially distribute Course resources;
- copy or substantially reproduce the Course to create another training programme, workshop or educational product;
- present The Latch Revolution's original frameworks, resources or materials as your own; or
- record or reproduce Course videos, presentations or other protected materials except where functionality has specifically been provided for personal downloading.
Nothing in this section prevents you from incorporating what you have learned into your own professional practice, discussing relevant concepts with colleagues, or educating and supporting your own clients within your professional role.
Where we reasonably believe substantial unauthorised copying, sharing or distribution has occurred, we may suspend or terminate Course access and may take appropriate steps to protect our intellectual property rights.
- Feedback, Reviews and Testimonials
We value feedback because it helps us understand participants’ experiences and improve our education.
Providing feedback does not automatically give The Latch Revolution permission to publish your words, name, photograph, professional title, likeness or personal story for marketing purposes.
Comments made in emails, Course discussions, live sessions, direct messages, surveys, social media conversations or other communications will not automatically be treated as testimonials.
If we would like to use identifiable feedback or a participant's words as a testimonial or promotional material, we will seek appropriate permission.
Where feedback is collected specifically for possible publication, we will make this clear and provide appropriate choices about how the feedback may be attributed.
You are under no obligation to provide a testimonial or agree to promotional use of your feedback. Declining permission will not affect your Course access or your relationship with The Latch Revolution.
Where permission has been given, you may subsequently contact us at [email protected] if you wish to withdraw permission for future use. We will take reasonable steps to stop future publication or use, although we may not be able to recall material that has already been lawfully published or distributed.
- Clinical Cases, Questions and Participant Contributions
The Course may provide opportunities for participants to submit questions, discuss clinical situations or contribute cases for educational discussion.
You retain ownership of your own original contributions.
Submitting a question or case does not transfer ownership of your material to The Latch Revolution and does not automatically give us permission to use your story or contribution for marketing.
Where a case is submitted specifically for discussion during a Course session, clinical review, Q&A or similar educational activity, you give us permission to use the information for that stated educational purpose.
Participants are responsible for removing or changing identifying information before sharing information about clients, patients, babies or families.
Please do not submit names, dates of birth, addresses, photographs or other information that could reasonably identify a client or family unless there is a lawful and appropriate reason to do so and any necessary consent has been obtained.
We may further edit or anonymise submitted information to protect privacy.
If we would like to use a participant-submitted case for a substantially different purpose — for example in future teaching materials, public education or promotional content — we will seek appropriate additional permission where required.
- Professional Responsibility and Scope of Practice
The Course is educational in nature.
It is designed to support professional learning, observation, clinical reasoning and discussion. It does not replace professional qualifications, appropriate clinical assessment, individualised care, medical advice, referral pathways or professional judgement.
Participants remain responsible for:
- practising within their own professional scope and competence;
- following the requirements of their professional or regulatory bodies;
- complying with applicable laws, standards and local clinical guidance;
- recognising when assessment, referral or care from another professional is appropriate; and
- making their own professional decisions in relation to individual clients and families.
The Course should not be interpreted as instructing a participant to diagnose or treat a condition outside their professional scope.
Continuing Professional Development
The Course provides the number of CPD hours stated in the current Course description or certificate.
Recognition of CPD or continuing education varies between professions, organisations and countries. Participants are responsible for confirming whether the Course meets the requirements of their own professional or regulatory body.
- Live Sessions, Recordings and Community Participation
The Course may include live teaching sessions, Q&A sessions, case discussions, community areas or other opportunities for participant interaction.
Where a live session will be recorded, participants will be informed.
If you do not wish your image or voice to appear in a recording, you may choose to keep your camera and/or microphone switched off and participate using available alternatives such as written chat, where technically possible.
Recordings are provided for educational purposes and are not automatically licensed for promotional use.
Participants are expected to communicate respectfully and professionally.
We will not tolerate harassment, discrimination, threatening behaviour, deliberate disruption, or serious breaches of another participant's privacy or confidentiality.
We welcome respectful disagreement, professional debate, questions and constructive criticism. Nothing in these Terms prevents a participant from expressing an honest opinion about the Course or The Latch Revolution.
Where behaviour seriously or repeatedly affects the safety, privacy or reasonable participation of others, we may remove a participant from a community or live session. In serious circumstances, Course access may also be suspended or terminated.
- Confidentiality and Participant Privacy
Professional discussion often involves real clinical experiences. Participants must respect the privacy and confidentiality of other participants and of the families and clients discussed during the Course.
Information shared by another participant about their professional practice, clients or personal experience should not be copied, published or shared outside the Course without appropriate permission.
Participants must also comply with their own professional confidentiality and data protection obligations when discussing clinical situations.
This confidentiality requirement does not prevent anyone from making a disclosure that is required by law or by an applicable professional or safeguarding obligation.
- Educational Disclaimer and Limitation of Liability
We aim to provide thoughtful, evidence-informed professional education. However, healthcare knowledge and professional guidance develop over time, and no educational programme can address every individual clinical situation.
We do not guarantee particular professional, clinical, financial or business outcomes from completing the Course.
Participants remain responsible for how they interpret and apply Course information within their own professional practice.
To the extent permitted by applicable law, The Latch Revolution is not responsible for indirect or consequential loss resulting from a participant's independent professional decisions or use of Course information.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any rights or protections that cannot legally be excluded.
- Suspension or Termination of Access
We may suspend or terminate Course access where there has been a serious or repeated breach of these Terms, including:
- substantial unauthorised sharing or distribution of Course materials;
- sharing Course login details;
- non-payment of agreed Course fees;
- serious breaches of confidentiality;
- harassment or threatening behaviour; or
- other conduct that materially interferes with the rights, privacy or participation of others.
Where appropriate, we will normally attempt to resolve concerns before terminating access. However, immediate action may be taken where reasonably necessary to protect participants, confidential information, intellectual property or the integrity of the Course.
Whether a refund is appropriate following termination will depend on the circumstances and any rights available under applicable law.
- Privacy and Data Protection
We collect and process personal information necessary to administer purchases, provide Course access, communicate with participants and operate The Latch Revolution.
More detailed information about how personal data is collected, stored, processed and shared should be set out in our Privacy Policy.
Where required by applicable data protection law, personal data will be processed using an appropriate lawful basis, which may include performance of a contract, compliance with legal obligations, legitimate interests or consent.
Consent to receive optional marketing communications is separate from the purchase of the Course and may be withdrawn.
We do not treat the purchase of the Course as automatic consent for identifiable testimonials, promotional use of a participant's image or other optional marketing uses that require separate permission.
Data Protection Rights
Depending on where you live and the laws that apply, you may have rights relating to your personal data, including rights to:
- request access to personal information held about you;
- request correction of inaccurate information;
- request deletion in certain circumstances;
- request restriction of certain processing;
- object to certain processing;
- request data portability where applicable; and
- withdraw consent where processing relies upon consent.
These rights are subject to the requirements and exceptions of applicable data protection law.
Requests concerning personal information can be sent to [email protected].
Where applicable, you may also have the right to complain to the relevant data protection supervisory authority.
Third-Party Services and International Processing
We use third-party providers to operate aspects of the Course and business, which may include services for Course hosting, email, payment processing and online communications.
Personal information may therefore be processed in countries other than the country in which you live. Where required, appropriate data protection safeguards will be used.
Further information should be provided in our Privacy Policy.
- Changes to the Course or These Terms
We may make reasonable changes to the Course, its materials or these Terms from time to time, including where necessary to reflect changes in technology, professional knowledge, law or the way the Course is delivered.
Changes will not be used to remove rights already accrued under a completed purchase where doing so would be unlawful.
Where a material change significantly affects existing participants, we will make reasonable efforts to communicate that change.
- Resolving Concerns and Disputes
If you have a concern about the Course, a payment or these Terms, please contact us first at [email protected].
We will aim to address concerns fairly and in good faith.
Nothing in this section removes any legal rights or dispute-resolution options that are available to you under applicable law.
- Governing Law
These Terms and Conditions are governed by the laws of Switzerland.
Any dispute arising in connection with these Terms or the Course will be addressed in accordance with Swiss law, subject to any mandatory consumer protection rights or other legal rights that may apply to a participant in their country of residence.
- Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
- Entire Agreement
These Terms, together with the Course description, checkout terms and applicable Privacy Policy, form the agreement relating to your purchase and use of the Course.
